Bond Hearing

to Establish Release

If you or your loved one is detained by immigration authorities you may challenge the detention by requesting a custody redetermination hearing – commonly known as a bond hearing.

At the bond hearing an immigration judge will consider the person’s family and community ties to the United States, whether they have a criminal history, and the likelihood of them showing up for future court dates, among many other things.

The detained person may have a lawyer represent them at the bond hearing. The lawyer helps present evidence and arguments to show why the person should be released on bond, and advocates for a low bond amount being set.

If you are eligible for release the judge may set a bond amount that must be paid in order to release you. The bond amount is refunded if the detained person, once released, continues to show up to their future court hearings.

Bond Hearing

to Reduce Bond Amount

If you or your loved one are eligible for release, but the Immigration Judge or ICE has set a bond amount that is too high for you to pay, you may be able to have the amount reduced.

At a Bond Re-determination hearing the Immigration Judge may consider your ability to pay, and consider new evidence showing that you have ties to the United States, and that you are not a flight risk.

Please note, if the hearing is successfully, the bond amount may be lowered significantly, but the lowest possible bond amount that the Judge may set is currently: $1,500 USD.

Release Request

with ICE

ICE has discretion to release detained individuals based on humanitarian reasons. They may do this without an Immigration Judge’s permission.

Requesting release from ICE is formally known as a Parole Request. If successful you may be released from detention, and can proceed with your case from a United States residence.

Bond Reduction Request

with ICE

ICE has discretion to reduce bond amounts that they have set. They may do this without an Immigration Judge’s permission.

Stay of Deportation

Discretionary Relief

If your loved one is detained and has a deportation order you must act fast. Within 30 days of the deportation order, or before the the order is carried out, ICE has the discretion to stop a deportation order. If the request is granted your loved one may remain in the United States for the length of time that you requested.

Stay of Deportation

Motion to Reopen

If you lost an immigration case, were issued a deportation order, and are currently detained, its possible that you may have your case reopened. Reopening a finished immigration case requires new evidence that you did not have in your original case.

You must act quickly to file your reopening petition. You must file it before you are deported. If you are successfully reopening your case, you may be able to stop your deportation, and re-try your lost case.

Motion to Reconsider

If you lost an immigration case, were issued a deportation order, and are currently detained, its possible that you may have your case reconsidered. Reconsidering a finished immigration case requires identifying that there was an legal error that was made in the past case.

You must act quickly to file your reconsideration petition. You must file it before you are deported. If you are successful at having the case reconsidered you may be able to stop your deportation, and re-try your lost case.

Credible Fear Interview

Request (Asylum)

If you are detained at the border or anywhere in the United States you have a right to request asylum. The first step in the asylum process is typically requesting a Credible Fear Interview be conducted.

A Credible Fear Interview is used to establish that you are afraid of returning to your home country. If you are detained you may have limited time to request one. If you pass the Interview you will be allowed to have a full hearing in front of an immigration judge to prove that you deserve asylum.

Credible Fear Review

Court Hearing (Asylum)

If you have had a Credible Fear Interview and it came back negative, it means the government does not believe that your fear is credible enough to apply for asylum – there is hope however. You have the right to have an Immigration Judge review the negative Credible Fear result, and you have the right to have an attorney at this hearing.

The Immigration Judge may reverse the governments decision and find that your fear is credible. If your fear is found to be credible then you will be allowed to continue with your asylum case.

Reasonable Fear Interview

Request for Past Deportees (Asylum)

If you have been deported in the past, and are now detained in the United States, you may still apply for asylum if you have a reasonable fear of your home country. 

You must act fast though, it is possible that you have a past removal order that might have you deported very quickly. Requesting a Reasonable Fear Interview is the first step in the asylum process for someone with a past deportation.

Appointment Scheduling Assistance

If you are in the US Mexico border region and would like help setting up an appointment with Customs and Border Protection, we can help. A CBP One appointment is typically the first step in entering the United States as an asylum seeker.

We have offices in Tijuana Mexico that can help you set up your appointment, and we can also help you remotely via teleconference to set up an appointment if you are in a different area.

CBP One

Attorney Presence at Border

If you already have an CBP One appointement or if mutliple appointment requests have failed.

We have offices in Tijuana Mexico that can help you set up your appointment. We can also help you remotely via teleconference to set up an appointment if you are in a different area.

Locate a Detained Person

in ICE Custody

If Locating a loved one in ICE Custody is usually a straight forward process. We invite all our clients to conduct this search on their own using the ICE LOCATOR WEBSITE.

However, if you require additional assistance we may schedule a location session. A licensed immigration attorney will conduct a live 45 minute search to locate the detained individual.

Locate a Detained Person

at the Border (CBP)

Someone who has recently crossed a US Border and is suspected of being in Customs and Border Protection (CBP) custody is difficult to find. CBP may or may not release information regarded a recent entrant.

In most cases, we advise our clients to wait until the Detained person contacts you, or until they are placed in ICE custody. However, if you would like assistance beginning a search with CBP we can help.
