Asylum

in Immigration Court

If you are in the United States, and are afraid of returning to your home country, you may qualify for asylum.

To qualify you must be: (1) afraid of returning to your home country, (2) you are afraid because you were hurt in the past or you are afraid of being hurt in the future, (3) the people who hurt you (or might hurt you in the future) are hurting you because of your race, religion, nationality, political opinion, or because you are different from most people, and (4) the people hurting you are associated with the government or someone as powerful as the government (a cartel, a powerful family member, a religious figure etc.). 

The benefits of asylum are that you (1) may eventually work legally while your case is pending in court, (2) you are not deportable while your case is pending, (4) if you win asylum you can get a green card one year after you win, and (5) if you win you may sponsor others to come to the United States.

Common Additional Fees:

  • Multiple Family Members: $1,000 per each additional family member included in the application (no additional fee for children under 14).
  • Additional Asylum Grounds: $1,000 for each additional reason that you have to apply for asylum. The base price only covers one reason you may have for requesting asylum.
  • Changing Court Location: $1,200 if you move to a different area of the United States, and would like to change court locations.
  • Change of Address: $240 to inform the court that you have moved.
  • Addresing an Asylum Bar: $2,000 per bar that will need to be addressed in your application.
  • Emergency Representation: $1,000-$2,000 if you contact our office within one month of your court hearing.
  • Work Authorization: $400 to apply for a work authorization card.
  • Certified Translations: $30 per page up to 250 words. 10 Cents per word in excess of 250 words.

How long after my entry may I apply for asylum?

You have one year after you last entered the United States to apply for asylum.

I missed the one year deadline for asylum. Can I still file?

Yes, you may file for asylum late if you can show that either (1) extraordinary circumstances stopped you from filing on time, or (2) there are changed circumstances in your life or country.

If I win asylum, will my children gain status too?

If your children were 21 years or younger, and unmarried when you filed your asylum petition, they may get status under the Child Status Protection Act. If the child is within the United States, and you included them in your asylum application, when you win asylum they win too. If they are outside the United States or you forgot to include them in your asylum application, you can still petition for them by filling a I-730 within 2 years of winning asylum.

Can I work?

You may apply for a work authorization card 150 days after you have filed your asylum petition with the court. After and additional 30 days USCIS will typically mail out your card.

Cancellation of Removal

for Legal Permanent Residents (LPR)

If have been a legal permanent resident (LPR) for 5 years, and you find your self in deportation proceedings you may be able to have a judge give you back your green card.

To qualify you must: (1) have been a LPR for 5 years, (2) you have been continuously living the United States for at least 7 years (in any status), and (3) you may not have been convicted of a aggrevated felony. 

the benefits of Cancellation of Removal for LPRs are: (1) if you win you get to keep your green card and remain in the United States.

Frequently Asked Questions

I lied to get my LPR status. Can I get LPR Cancellation?

No. If you received your LPR status because of a fraud or mistake then you do not qualify for LPR Cancellation of Removal.

I only have 4 years as a LPR, can I still apply?

Maybe. You must have been a green card holder for 5 years to qualify for LPR Cancellation, but while your waiting for your trail date the time keeps going. If your case takes along time to begin in immigration court, you may reach the 5 year threshold.

How do I know if I have an aggravated felony conviction?

An aggravated felony is poorly defined under current immigration law. A state aggravated felony might not be an aggravated felony for immigration purposes. Generally, you have an aggravated felony conviction for immigration purposes if (1) your sentence was over 1 year, or (2) there were over 10,000 USD involved in your criminal case. This is a complex topic, hiring an experienced immigration lawyer will be very important to your case.

I'm not in immigration court, can I apply for Cancellation?

No. Cancellation of Removal (both LPR and non-LPR) are only available through the decision of an immigration judge. If you are not in immgration court you cannot get a immigration judge decision. 

Cancellation of Removal

For Non-Green Card Holders

Cancellation of removal for non-legal permanent residents (non-green card holders)is a process that allows certain individuals who are facing deportation to apply to an immigration judge for a green card. To be eligible a non-green card holder must show at least 10 years of continuous physical presence in the United States, good moral character, no convictions for certain criminal offenses, and that their deportation would result in exceptional and extreme hardship to a U.S. citizen or lawful permanent resident spouse, parent, or child.

Cancellation of Removal

For Victims of Domestic Violence

Cancellation of Removal under the Violence Against Women Act (VAWA) is a form of relief for survivors of abuse who are facing deportation. If granted by an immigration judge, this form of Cancellation can provide a pathway to a green card.

To qualify you must show battery or extreme cruelty by a US citizen or legal permanent resident spouse, child, or parent, presence in the US for three years, extreme hardship to to you or a family member, and that you are not inadmissible. If your abuser was your spouse you must show that the marriage was entered into in good faith.

Self Deportation (legally known as voluntary departure) is the process of leaving the United States on your after properly informing immigration authorities. If done correctly, by choosing to deport yourself, you may avoid immigration penalties, and bars in the future.

Greencard through Family or Marriage

in Immigration Court

If you are in immigration court proceedings and have a close relative who is a US citizen or Legal Permanent Resident that is willing to sponsor you or you get married to a US citizen or legal permanent resident then you may have a path out of deportation proceedings. Filing a defensive adjustment of status application with the immigration judge is very complex, but if granted you may end up with a greencard.

Termination

of Your Immigration Court Case

If you no longer want your your case presented before an immigration judge, you may attempt to request your case be terminated. There are several reasons you may want your case terminated. However, in most scenerios termination is discretionary on the part of the immigration judge and requires negotiation with the government attorney trying to deport you. If granted you will no longer be required to go to court.

Motion to Reopen

Your Immigration Court Case or USCIS Case

If your court case or USCIS case has been recently closed, either because it was terminated or you lost and are deportable, and you have new facts not present during your case, you may be able to reopen it and try again. If granted you will return to court or USCIS to prove your case.

Your Immigration Court Case or USCIS Case

If your court case or USCIS case has been recently closed, either because it was terminated or you lost and are deportable, and you believe it was the law was applied wrongly by the court or USCIS you may request your case to be reconsidered. If granted your case will return to court or USCIS, and the erroneous decision might be changed.

Waiver of Fraud

for Green Card Holders

People who were admitted into the United States due lying, and were later caught in the lie are usually deportable for having lied. However, there is a waiver available to excuse the lie, and keep you in the United States. The waiver is known as the 237(a)(1)(H) waiver.

This waiver is only available if you are in immigration court proceedings. If the judge grants the waiver you may be able to keep your green card. This waiver is most often used when someone lied about the validity of their marriage, and is available if you have a conditional two year green card or the permanent ten year green card.

Generally, to qualify for this waiver you need (1) to be in immigration court, (2) not be inadmissible for any other reason other than the lie you told to get in, (3) have either a qualifying close family member or be the victim of domestic violence.

Special Immigrant Juvenile Status (SIJS)

in Court

Children in immigration court may be able to ask the judge for a green card if they have been abandoned, abused, or neglected by one of their parents.

To Qualify for SIJS protection the child must: (1) be under the age of 21 and unmarried when they file the SIJS application, (2) the child must be declared a dependent by a United States “juvenile court,” (3) the juvenile court must determine that reunification with one or both parents is not viable due to abandonment, abuse or neglect, and (4) it is not in the child’s best interest to return to their home country. 

The benefits of SIJS are that (1) you cannot be deported while you are waiting for SIJS, (2) once you receive SIJS you will get a green card, and (3) you can sponsor others to immigrate to the United States..

  • Work Authorization Card: $400 if you would like for us to apply for a work authorization card.
    Certified Translations: $30 per page up to 250 words. 10 Cents per word in excess of 250 words.

Appeal

with BIA

If you lost your case with the immigration court, you may still appeal to the Board of Immigration Appeals (BIA) or with the Federal Courts. See below for Federal Court Appeals. If the appeal is won, you may either return to the immigration court for further consideration of your case or you may outright win the immigration benefit that you need to stay in the United States.

Appeal

with Federal Court

If you lost your case with the immigration court, you may still appeal to the Federal Courts. Federal court appeals is also an option if you have been denied a BIA appeal. If the appeal is won, you may either return to the immigration court for further consideration of your case or you may outright win the immigration benefit that you need to stay in the United States.
